General Terms and Conditions of the „Hubertus Pharmacy” Dr. Dominik Schantl

Scope
Conclusion of an agreement, offer, delivery and accomplishment of the Hubertus Pharmacy, Dr. Dominik Schantl, is only affected on base of this General Terms and Conditions. The General Terms and Conditions are accepted by placing an order through a customer. The General Terms and Conditions may be amended at any time. The relevant version is the updated one that is up to the time of arriving of an order by a customer at the Hubertus Pharmacy.


Conclusion of an agreement
An agreement is only accomplished when the Hubertus Pharmacy accepts an order. The order acceptance occurs by telephone or electronically message.


Prices and Validity
All offers and information to offers are without engagement and obligation. Our prices are gross-prices in Euro and include all legal duties, e.g. general sales tax.
The prices do not include any costs of shipping or importation.
Price marks of pharmaceutical products follow the legal considerations, e.g. law for prices, medical tax. The catalogue price of the current day on that the order arrives to the Hubertus Pharmacy is counting. The price are current prices and go from 0 a.m. to 24 p.m.
If you have a current prescription or an allotted prescription of the chief physician and you do a pre-order, then the prices are only for information and you just have to pay the current prescription fee.


Paying terms and reservation of proprietary rights
The goods are property of the Hubertus Pharmacy up to the full payment of all demands on the customer who placed an order.

The payment has to be made within 14 days from date of invoice.

The payment can be effected by pre-payment, payment form or payment card, e.g. Maestro, Quick, Paybox, Master, Visa, Amex, Diners. However we reserve the right to demand total or part pre-payment.

At delayed payment we charge overdue fines of € 6,18 per demand note and interest for default of 12% p.a. as well as collection costs according to the edict of collection rates.

At payment with payment cards disagio costs can be charged. They are shown separately from the order processing company.


Terms of delivery
The goods are delivered to the address the customer specified in his order not before the amount of invoice has been arrived to the mentioned business account. Special goods, that are productions and supplies at home and abroad, have a longer time of delivery. We inform our customers about longer times of delivery or delivery delays as soon as possible. That releases us from any promises.


Delivery in Austria
Home delivery takes place during 3 working days (normal transport time, not guaranteed) after order acceptation through the Hubertus Pharmacy or preservation of confirmation of payment.
At pickup by the customer the ordered products are reserved for 14 days.


Rescission
The customer has the right to withdraw from a contract during 3 working days after delivery. The customer has to notify the Hubertus Pharmacy in writing. The customer bares the full costs for the reshipment.


Return of defective goods
Complaints of delivered products are regarded 8 days after the delivery has been received. The customer has to notify in writing about the deficiency. Damages through the transport have to be put to record to claim for compensation. The customer gets an invoice-related credit note. Therefore the invoice has to be presented.
The customer bares the full costs for postage and handling, when the goods are returned to sender for non-acceptance, non-collection or other customer-related causes.
The customer has the right to trigger a claim inquiry. At self-confliction the customer has to bare the full costs for the claim inquiry.
